Hi Gurus, My L1 individual Visa and I-94 are getting expired on 13th Setp 2009. My employer has not applied for extension yet but will do in 4-5 days. I am thinking of various options available for me and need your guidance.
First of all let me put down what my plan is considering worst case scenario -
1. Go for L1 Individual extension under premium processing.
2. If I get REF on that before I-94 expires (13th Sept 2009), withdraw the application and apply for fresh L1 individual extension
3. While new extension is in progress, apply for FRESH L1 Blanket petition which I assume be quicker than the regular extension process.
4. If new L1 blanket gets approved, go to CANADA and get it stamped. In this case, withdraw the extension case since L1 blanket Visa is stamped.
5. If L1 blanket gets rejected, wait for decision on L1 individual approval/rejection.
6. If rejection comes on both,,go back to home country (India)
Based on this plan, I have few doubts -
1. Can I apply for NEW L1 Blanket visa while in USA with I-94 expired and L1 individual extension is in process?
2. Can NEW L1 Blanket petition and L1 individual extension go parallel?
3. What is/are the problems that you see with my plan?
4. How long it takes to get NEW L1 Blanket petition approved/rejected? I heard that it very quick but not sure how quick (in days)from the date of submitting required documents to USCIS.
5. I am NOT from Computer Science background but working in IT industry from more than 5 years..am I eligible for applying for NEW L1 Blanket petition? I heard that Blanket is only for computer background professionals but not sure about that.
6. If I am not eligible for Blanket Petition..what
