L1-i 140/485 Issues

HERE IS MY SITUATION:

1. I-140 APPROVED(EB1) FEB 2002
2. I-485 PENDING SINCE JUNE 2002

I WAS ON L1 VISA with MY PREVIOUS EMPLOYER. CHANGED JOB and JOINED A NEW COMPANY AFTER COMPLETING(300 days) in I-485.WORKING ON EAD NOW.

MY PREVIOUS EMPLOYER IS CANCELLING MY L1 and I-140. THEY ARE TELLING ME AC21 PORTABILITY DOES NOT APPLY TO MY CASE SINCE I WAS NOT ON H1B(MY VISA WAS L1A).

WHAT SHOULD I DO NOW? SOME ATTORNEYS ARE SAYING THAT AC21 STILL APPLIES TO MY CASE and I DO NOT NEED a H1??

PLEASE ADVISE.

I read the AC21 statute. I think it applies only to H1B. Since Section 106(C) is part of it, do you think L1 cases will still be handled as per AC21 statute?
 
We're in a similar situation. We filed our I-485 over a year ago (I-140 has been approved) and it's possible that my husband, who has an L1-A visa, may lose his job in the next round of redundancies at his work before the green card comes through.

Would it be a good idea for him to apply for an EAD now, so that he already has it if he does lose his job? All our immigration stuff is handled through his company's legal department though, so we're worried that if he applies for an EAD they'll think he's planning to resign.
 
Thanks for your reply Joe - yes, we do have the receipt notice.

We were looking at the BCIS site and it looks like he can apply online for his EAD so I think we'll try that.
