I'm in a strange situation. I just wanted some experts views on my situation.
1. I came to USA with L1B visa - 2006 - Company A
2. Got H1 approved with COS 2007 Apr - Company B
3. I didn't joined Company B as they had some Audit problems that time, and I filed my L1B extension to void my H1 for time being..
4. My L1 Extension got an RFE, I travelled back to India in Feb'08 and came back to USA with brand new L1B..
5. I then continued on L1B all this time..
6. Company B because of all Audit problems, they said - they had to send a cancel request for my H1 -they also said, since I made it through 65K quota, I can still get my H1 COS approved from different employer anytime.. since I actually never worked for them(Company B) before...I dont have to supply any payslips from them to new company that files H1 COS now...
Now, my question is - I have my original H1 issue notice (valid until 10/2010).. can I get COS done through different employer ?? Would it bring me back to H1 status... ?? If not, I'm thinking of applying new H1 this year...
