L1 converted to H1. what is the status now?

Hi,

My L1 was valid till March 2005. But I got my H1 processed by a new company and it was approved on 30th Nov. Now, currently due to unavailibilty of project i am still with my old company (L1 visa). I've following qsns and concerns:

a)Is my L1 still valid? I am on which Visa now - L1 or H1?
b)How long can I continue with my old company?
c)Can I make a complain to INS/Visa authority saying that my new company has taken me for ride, as they have no job for me!

It all depends. When your H1b sponsoring company applied for your H1b, they could also apply for your change of status from L1 to H1b. If they did, then your new status is H1b from the date stated in the approval notice. When in H1b status you can only work for the H1b sponsor. You cannot continue to work for the previous employer.

No matter the actual reality of the consulting business, an H1b sponsor is required to pay your prevailing wage as set forth in the labor certification. They're violating the rules and regulations if they don't pay you even when on the bench.

Now, for the right course of action you should always consider how strong your position is. Filing complaints with all kinds of agencies might be the right thing to do, but you should first make sure you are in status. I suggest you consult with an attorney for the appropriate actions.

I will try to get into new status asap. from others also, i've got the same advise. Until i am in new status, I can't proceed further.
