My friend has L1-B from Company X valid till Oct 2007. Company Y is ready to apply for H1B shortly with a very good offer. Now he has the following questions
1) Will the L1-B visa from Company X gets invalid, only if, Company Y applies for H1 along with COS or the L1-B will be invalid automatically, whether or not COS is applied along with H1?
2) If the H1B visa is applied WITH OUT COS
A) Can he start working for Y, from approved H1B start date?
B) Will it affect his I-94 obtained when he entered using L1-B ?
C) should he necessarily go to India and get the stamping even to start working on H1?
Even though he does not have H1B stamping, the I-94 that he got when he entered US using L1-B is valid till Oct 2007. So why should he go out of country and obtain stamping merely for working on H1 ?
