L1-b Stay In Us

I AM CURRENTLY ON L1-B from past 3.5 years in US,through my company..

1.I heard that maximum stay in US on L1-B is 5 years..If i goback to India
and stay there for one year...and comeback on either L1-A OR L1-B
whether my previous stay of 3.5 years will be accounted in total stay of 5 years... or the count will start freshly...


2.what happens if i go back to india and stay there FOR ONE YEAR and come back on H1-B ....can I stay here for 6 years...or my previous stay will be accounted on H1-B SPAN ...


3.pLEASE CONFIRM HOW THE TOTAL STAY IN US ON each visa is accounted
 
As per the regulations a person who has spent five years in the United States on L-1B or H status, may not be readmitted to the United States under L or H status unless the alien has resided and been physically present outside the United States, except for brief visits for business or pleasure, for the immediate prior year. I think if you remain outside of US for more than one year, then the period starts afresh.


I think you will be able to stay for another 5/6/7 on L-1B/H-1B/L-1A visa after you spend 1 year outside US.
