I work in an Indian firm and am on L1 B with my family.Am currently in the US. Our visa and I94 both are getting expired 18th may 2009. On enquiring with my company they want me to go back to India for getting new L1B as they say they will not extend the visa and I94 from US.
Now my question is, if I plan to apply for H1B for the year 2009-2010 and assuming my H1B(and my wife's) reaches USCIS on Apr 1 2009, will it mean that I would not be able to get a L1 B extension during the same time as well?
Also is there a way, my petition being blanketed, get a visa date pretty quickly incase I plan to go to India(Mumbai) and get a new L1 b visa and come back? The client has plans to extend my project for the whole of next year.
Any help would be deeply appreciated.
