Hello,

Could you please answer following questions.



1.I came to UK to work for the same employer who i worked for 6 yrs on H-1 in USA before i failed to qualify for H1 7th year extension.I came here on managerial post and would like to go back to the same company in US after completing one full year in UK..
Should i prefer L1-A or H1-B to come back to US?

2.How long should i work on L1-A before I can apply for I-140/I-485 ?

3.What is the general risk of I-140 denial when applied on L1-A ?

The advantage you will have when you are on L1a status is that you can skip the labor certification and go straight for the 140/485 steps. .

Instead of waiting for a year outside the US, maybe you should check with your attorney to file for your greencard in advance. Remember, the employment based greencard is for a job in the future not necessarily for a job that already exist now.
