L 1A Visa Expiring

Hi,

Based on the feedback I got from this forum I should be expecting my CP interview in the next 6 months or so. My L1-A visa is expiring by end July 03 and my I-94 is stamped till july 04. The question I have is - will it be necessary for me to have my visa re-validated before I go for my consular interview ?? I do not see any point in doing that, as I understand that all my US visas( L1 and B1/B2) will be cancelled anyway before the interview .

You don't need to get your passport stamped with the new visa but you need to maintain legal status for your stay in US till the CP interview date. Just because you have I-94 till July 04, doesn't mean that you wil be in status after your L1-A expires in July 03 (if I understand what you have said in your posting is correct).

What I meant was my L1-A petition for the 1st 4 year term of L1 visa is valid till Jul 04 and hence my I-94 is also stamped in accordance with petition validity- I hope you mean petition validity when you say "maintaining legal status" in the US ? However (unfortunately) L1 visa's for Indian nationals (as you may already know) are issued for 1 year at a time and we're expected to re-validate as needed- my visa in this case expires in July 03.

Hope this answers your question and let me know if I will need to renew my visa again.

Your question is, whether you need to re-validate the visa
stamp in your passport.

You will need to do it only if you anticipate some travel after July 03 and before you attend your cp interview.

If not you do not need it.

The validity of I-94 has higher precedence than the visa date on the passport. So If your I-94 is valid till July 04, you should be OK. It might be better if you consult your attorney to be on safe side.

I am not very knowledgeable about how L1 extension work each year and what are the impacts on not renewing the L1 visa in time.

If I were you, I would play safe and get the L1 visa revalidated for the next year also. Atleast file for an extension in time. After you get the next year's extension, then you don't have to get the new visa on the passport.

To summarize, re-validation of the visa in the passport is not very important but getting the appropriate L1 extension is important.
