I am valid L-1B Visa holder and expires in JAN -2011 , but I am working in Canada for over a Year, the company is planning to bring me back to the US.

On a first meeting they are going to check with Inmigration lawyer, but they are suggesting that I need to get a new fresh L-1? Is this necessary can I just come back and file for an extension?

Your visa is still valid, and assuming you are on your initial 3 year approval you are eligible for a 2 year extension. Filing an extension is much faster (you can prepare the application and present it at a port of entry where it should be approved), and you also do not need to pay the fraud fee again so it is cheaper as well. The fact that you have been in Canada for a year has no bearing on your visa status.
