kid Adavance Parole expired while in India

Please post your opinions on this situation. My friend kid's AP expired while the family in india. Only the kid AP got expired , rest of the family got valid Advance Parole . They are coming on 29-Nov-2005 .

1.What are their options ?
2.Can kid be allowed to enter into US ?

Chances are - if they put you all on the plane - CBP Officer in the secondary inspection will not give you any trouble at the border. If he is a stickler - you can ask for deferred inspection for your child. Again, if you have papers that evidence your child's I-485 pending status - this should really not be necessary.

But if you want to be safe - schedule an appointment with the nearest US Consulate and talk to the Immigration / CIS Officer there. I am pretty sure they have forms/provisions for emergency or related travel authorization.

Am not so sure .... every alien needs either a visa/visa waiver/AP to enter ...

Don't take this lightly -- you need to get a CONFIRMED response about this before you travel -- the POE can very easily not allow your kid to enter.
I doubt if you can get some "emergency" travel doc abroad as an expired AP is not an emergency - its just a mistake on your part.

And another thing to remember .... you don't have an immigration/customs officer in the consulates abroad -- all you have is Dept Of State folks & they are not very empowered to mess with USCIS issues (& vice-versa)

This is SERIOUS -- I wish you good luck -- contact your attorney here and see if they know from experience how POE officers would handle such a case.

I remember at JFK, an indian lady was crying but an officer strongly acting as per rule for expired APs of her 2 minors.
Please act accordingly, chances are 50-50.
