Key questions....Hope some one can answer thoroughly

1). I have my approved I-140. My I-485 was received at one of the USCIS center on Nov. 27th. So it has been only three months now.
What if my employer goes out of business now (Less than 180 days) and my I-485 case is still pending?
Out of business....it can be simply close the doors without filing for bankruptcy or filing for bankruptcy (any chapter)? Does it matter?






2). So how can i change the job in this case considering that i don't want to spoil this whole green card process? And keeping the I-485 application still alive.







3). If i can avail AC21, then when do i need to inform USCIS? Which documents? Any fees?
Should i submit a letter to employer that i intended to remain with initial employer indefinitely but they went out of business.
Also, I ssume the job letter should have same job description as my LC & vis apetition. How about salary? How about geographic location (different state)? Does it matter?







4). Many people say that even in such cases, if employer is out of business, i should wait for 180 days before i change the job (with ofcourse same job description). Is that true? Then there will be a gap of three months and what if i get RFE (or NOID) from USCIS to show the pay stubs during this time?






5). So my point here is can i change job immediately after three months (before 180 days)....though not intentioanlly but if my employer goes out of business or should i wait until 180 days to complete?







6). There can be another case too....At this time, i am not looking for any new job hoping that this company won't be out of business if management makes some positive decisions OR if this company does not go out of business for 180 days..........
BUT if that doesn't happen and if i can NOT immediately find a job, then what will happen during that period? What if i get any RFE for any kind of a proof etc. etc? Would my I-485 be denied?







5). Then what if my case gets reviewed during this time, and USCIS knows that my employer has gone out of business (or filed for bankruptcy).........Would i get RFE or my case would be rejected automatically b/c i didn't inform USCIS for AC-21 (assuming that i wanted to wait for 180 days).







6). So when do i need to inform USCIS? Immediately if i get a new job right after the bad situation? OR wait until 180 days have passed since the submission of I-485, and then submit MY intent letter and a letter from new employer in order to invoke the portability doctrine?

Be realistic and hire a lawyer. Working cheap does get good results!!!
 
I would say - as long as your employer does not revoke I-140 within the 6 months of filing I-485 - U should be safe....

If he revokes the I-140 within the first 6 months of 485 Receipt Date...then AC21 would not apply....

For bankruptcy considerations.....U can think of yourself as a future employee of the company...So, U were intending to join the company when you got the greencard....

So, U could easily tell USCIS that after 6 monhts of filing I-485...I got a similar job offer from another company and you wanted to change your intent to join the other company.....

So, the key is your I-485 should last 6 months of 485 Receipt (or better still 6 months from I-140 Approval Date, just to be safer)

Don't worry...even if the company files bankruptcy....U should not be affected...

Nope it does not matter...think of yourself as a future employee ...as far as Green Card is concerned....

U can work for anybody U want....
as long as I-485 is pending for 6 months...

Think of yourself as a future employee of the comany for GC Process...so whether U work for them or for somebody else during the first 6 months....U should be fine...

After 6 months, U could say that you changed your intent to join from this company to another company

AC21 does not require informing USCIS at all...
But, it's safer to apply...

USCIS knows green card is for future employment...They never really ask for
paystubs...

What they really ask the employer is that - is the employment offer still valid/existing and employer needs to provide a job offer letter?
Providing paystubs can embolden your job offer letter, as you can say that you are already working....and are optional/not needed!

U can work for anybody....since U only intended to join the employer after getting green card!

U may get RFE for EVL (Employment Verfication Letter)...and the employer may have to provide a genuine job offer letter....saying that the job offer is still valid!

BOTTOMLINE - Your employer - if asked by USCIS within these 6 monhts....he shoud say that the job offer is still valid...
U can request your employer to provide one right now itself....

But, RFE typically come after 6 monhts...never this early usually

I would say...wait until 180 days before informing USCIS of AC21 change of employer...

U can work for anybody and under any visa/EAD....

transferring H1B - somewhere I heard may give a clue to USCIS - not sure how safe that would be!

Hee Hee....only thing is if I-485 gets denied ...U may be out of status right away....with H1B you will have dual status...and can always maintain H1B...and go on!

if U go to EAD...she autmatically goes to EAD, I think...

It is funny that you even have blank lines to make it easy(?) for anybody answering your endless list of questions.(some have more blank lines, may be you are expecting longer answers for those). It would be funnier if anybody can answer all those.
On the serious side, I do understand that everybody who visits here is looking for some answers, clues whatever. But for this kind of details you got to get a legal advise. Basically spend $$$.
