K3 visa trouble, please help! Need to know A-Z

Hi, we have been having a lot of trouble with the immigration process, and getting a lot of different stories from a lot of different immigration officers...

Right from step one they were telling us to do things we didn't have to do, and forgetting to tell us to do things we were supposed to be doing.

I am Canadian. My hubby is American. We applied for the k3 visa so that I could move back to the U.S. with him. We got that, and thought all was going well, until we received more paperwork months later saying that we had to go back to Montreal (where we originally when for the K3) and go again for the doctor's exam, and get my police certificate (again!) etc etc.

I called USCIS about it and they said that somewhere along the way we were misdirected and that I shouldn't have to go out of the country again. We received a letter this week saying that my appointment in Montreal is in 16 days! I wouldn't even have time to get that doctor's appt etc! That USCIS lady said that I'm supposed to do an adjustment of status or something and contact NVC to cancel the other thing...

I'm trying to contact the National Visa Center, but I cannot get through to anyone! I will keep trying...

I'm so confused. I was never good at anything that involved paperwork... is there someone who would be willing to explain it to me, from step A to step Z so that I know what we did wrong and how to fix it?

Oh another thing I'm upset about is that the $400 we spent to get this immigration visa is nonrefundable... even though we were misdirected! And now we'll have to spend another $400 to do the adjustment of status.

So now I want to know exactly what is left... but no one at USCIS seems to be able to help me!

You can talk to an attorney if you are not able to handle the paperwork!!

USCIS has been approving I 130 sooner than K3. Which means you will get your green card and you don't need K3 visa. What they might have told you is that I 130 has been approved and therefore to cancel your K3 visa application. You will need the results of your medical exam during your interview.

Also, you were not misdirected. Until September 04, approval of I 130 was very slow and the quick way for spouses of US citizen to get to US was through K3 visa. Since, september they have been approving I 130 sooner and I have heard attoronies discourging people from applying for K3, lately.
 
But the problem is I already have my K3 visa... and it's been approved and I am living in the U.S. but somehow they got confused and don't know that... :confused: So they are trying to make me do everything all over again!

I wrote them a letter and sent it priority mail so hopefully it will all work out good.

if they keep on giving you hard time, and do not want to comprise, try to get attorney to threaten them about your rights under constitution, it is usually not USC procedures to approve visa and ask your wife to go back while your wife is here in USA already and start all over again--NO! fight back my friend, YOU can easely argue that it will create hardship to you and your wife financial and it may even cause you to lose your job, and it violate your right to pursue happiness and liberty to support your family, and it violate your due proceess of immigration process 14th amandement. especial. if k3 visa has been approved and there is no evidence of foul play in your marrage; it make your case is even stronger to compel them to act according to the procedures. But going back it will be a mistake, and could create a problem for your spouse to come back on time.
