K3 visa-please help

Hi Friend

Registered Users (C)
Friends,

I am very close to getting my citizenship & wedding in india-->applying K3 for wife follows. Please help me on following:

1: Need to go to India immediately after getting citizenship. I can send my
wife's k3 petition (I-130) from india right?

2: And I need to be there for one and half month or so. Can I give that indian
address for communication upto then?

Thanx..

You can apply for I-130 from India, but that will be an international courier which might take a week for USCIS to receive from the time you courier it from India. You would need the marriage certificate as supporting document.

Since you are staying in USA (and have gone on vacation), your address would be an US address, not the address in India. Even if USCIS wants to send you the receipt notice or anything they would be sending to your US address. It might take a week or more for them to send you receipt after they get your packet.

So, summing up everything would be fine to give the US address, and you will be back in USA to see the receipt notice in your mail box assuming you apply for I-130 from India.

Note: Are you thinking about what if USCIS sends an RFE and you want to be there to fix it. Not to worry, your priority date will stay good, and you will have sufficient time to answer the RFE.

LEO,

Thanx for good info. Ya, I decided to provide US address.
And I have one more question about marriage certificate pelase.
IS it the certificate we get @ wedding time in religious marraige thru Priest?
IS that enough or some thing else? thanx..

The state registration department issues marriage certificate.

For example, here's the website of Tamilnadu registration department

http://www.tnreginet.net/english/smar.asp

I have read somewhere in the website that Hindu marriages are covered by the registration department, and for other religion - either they can use the registration department or can get the letter from the priest.

Leo,

Thanx for reply.
Actually I am christian & gonna get one certificate from wedding pastor thru marriage. As I also know, that is enough. But I am also hearing here & there like need to get one from Registration office also. I am trying to get confirmation on this. If u or any of our friends on this forum know more about it, pelase post here. thanx..

since registration department belongs to the government, it is a solid proof. on the other hand, getting it from church/priest also good enough. I know of a friend who had his birth certificate from the church for applying I-485. The I-129 F form/instruction for K-3 visa will give more details as well.
