K3 Visa Help.. Confused..

Hey, i'm new here. I applied for my now wifes Visa to come to the UK, but it was a little bit more straight forward than the US one.

We got married over a year ago now in California, but we reside in the UK, she has an Further Leave of Remain visa, which she can turn into an indefinate leave to remain. Anyway, i'm confused about the visa process for America, when I try and find out the information I see things about I-130s and K1/K2/K3 visas and its just really overwhelming. I was wondering if someone could maybe help point me in the direction of what I need to do in order to move to the US with my wife.

Obviously I would like to work, and we have savings, but we aren't going to move until July next year anyway, so time isn't really an issue. Can we apply to do it from here? Or do we have to do it in California. Just some general advice, links, or pointers would be nice.

Thanks

Hi there.
Im not too sure about the differences between further leave of remain and indefinite leave of remain......the general consensus is that if the US citizen has permission to reside in the UK and IS residing and has been residing in the UK for a minimum of 6 months, then they can petition for an immediate relative visa for you by filing directly to the US embassy.

This is a great position to be in as it is the quickest route to obtain a visa for a spouse (it takes about 6 months). Im sure further leave of remain is included as 'permission to reside in the UK' therefore you should be able to go this route. Im sure someone will chime in if Im wrong and if your spouse needs indefinite leave to remain (this area is not my forte). Anyway...to help you through this, (if you can so this route) you will be applying through what is known as Direct Consular Filing (DCF)....here is a very detailed step by step process of how you would file http://www.visajourney.com/forums/index.php?autocom=custom&page=dcf

If your spouse is ineligible for DCF, then instead they will have to petition for you via USCIS in the States for either a K3 visa http://www.visajourney.com/forums/index.php?autocom=custom&page=k3guide or a CR1/IR1 http://www.visajourney.com/forums/index.php?autocom=custom&page=i130guide1

Good luck
