My sister situation is a little bit complicated with the fiance's financial situation. He self-employed but due to the economy, his tax showed negative number under AGI. BUt he's fully employed now by the local company and have earned the w2 that meets the poverty guideline. Can he use joint sponsor? I am currently a lawful permanent resident (2 years conditional GC), will renew in July to 10 years. Can I be the joint sponsor?

US K-1 visa joint sponsor

Hi paustin,

Joint sponsors must be U.S. citizens or lawful permanent residents financially settled to support another person apart from own family.

He doesn't need a joint sponsor. As you said, he now has a regular job with sufficient income. For the I-134 which goes along with the K1 application, a job letter from the employer should be sufficient. Documentation requirements for the I-134 are less extensive than for the I-864.

By the time the K1 visa is approved and they get married and it's time to file the I-485 and I-864, he would have received his W2 for 2011 and filed his 2011 tax return, both of which would show sufficient income. And he should get another employment letter at that time.
