K1 denied because of marriage - please help

Hi, I'm new here, looking for help for a friend.

My friend is engaged to a girl from Central America. They have been completing the K1 visa process since September and were one step away from being approved. However, he is spending the summer down there and they decided to get married so that her family could celebrate with them before they came back up here. When they went for the final meeting for the K1 visa approval they were declined the visa because they had just gotten married. Now they have to do the K3 process and start all over again, and pay all the fees again. They have already paid over $1,500 in fees. He says it will take another 11 months for the K3 approval. They really want to come up her as soon as possible because he's in a Master's program and is trying to get into a PhD program. He's also teaching at a State University. Any advice? Is there anything they can do? Any help is greatly appreciated. Thanks so much in advance!

Thank you for your reply. He (the U.S. Citizen) is in Central America with her now. She has yet to come here because they were waiting for the K-1 visa. Is there any way he can bring her here faster? I think he is very frustrated because they almost had the K-1, but because they got married they can't use it anymore and have to start all over. I guess they should have waited to get married :(

Well, they messed up. If he has as much education as you say, he was perfectly capable of researching US immigration laws before they got married to determine that their current problem is well documented.

They have to follow the law. There is no way to speed up the processing. If he needs to be back in the US anytime soon, he will have to come alone.

The best thing they can do is to hire an immigration attorney to review their completed paperwork to make sure they have not made any mistakes that would further delay processing.
