If I am a USC can I use a K-1 visa to marry a nonimmigrant that came legally but is now out of status? She has already filed under 245i and is waiting for the result of that filling. Is it best to wait for that and then get married or mariage first. Thanks
You can marry now and apply for PR. Since you are a USC anbd she entered the country legally, you do not have to depend on 245(i). K-1 will not apply in this case.
