Just when I thought I was over

I got approval on 15th June (April 2002 case). My wife (derivative) got an RFE. She worked on H1 5 years ago. Then she lelf the country, got H4 stamp and quickly came back.

INS wants to see the proof that she acutally left the country (they know she came back ...they just don't know if she went out... ha ha ha ha). Pretty strange... isn't that why we surrender I-94 at the time of departure.

Fortunately, Indian immigration puts a stamp on passport at arrival/departure. We are sending a copy of that. The stamp is so light that I had to find a top of the line color printer to capture it.

If she has previous I-94 photocopy, you can send that too - along with her current I-94. In a cover letter write down her date of departure and arrival dates. If they shredded I-94 without recording, it's their problem. If your still have flight ticket receipt (the last page of ticket book) or boarding pass, you can add their photocopies too.

I have I-94 number which my lawyer is sending along with color copy of all the pages of passport showing arrival stamp. It happened 5 years ago; obviously, don't have boarding pass or tickets....

lets see how it will turn out.

I keep even the grocery receipts from 5 years ago !
In case, you know... They wanna proof that I not just worked,
but eat while here... (wont mention the toilet paper... :) :) :) )

Nooo ! How can you ? Its in case some RFE asks for them...
And not just that ! As I wrote earlier, it is also the toilet paper...

Is this a strange paradox? How could she have obtained an overseas H4 visa UNLESS she left the country to get it? Isn't the mere presence of a dated H4 in her passport proof that she left to go and get it?

I guess they wants to check that she left USA soon enough after she gave up her H1 status.

Man, that IIO must have had a rough day to give a derivative applicant such a ridiculous RFE. Talk about nit-picking.
 
thats correct. but the visa stamp was issued on Feb 7th, which in itself is a proof that she left within 10 days (grace period for leaving the country) of leaving the employment oh H1.
