I am writing that letter to my District Director of Orlando USCIS regarding the fact that if my case is not resolved within 30 days, I will be filing the WOM.
However, I was just wondering aint that filing the WOM strictly not a better idea?
as you may know, I had I-485 and I-130 through marriage.
I-485 & I-130 received: 11/03/2005 - 1,223 days ago (3 years, 4 months, 7 days)
First fingerprinting 2/17/2006 - 1,117 days ago (3 years, 21 days)
Interview 09/13/2006 - 909 days ago (2 years, 5 months, 25 days)
Last fingerprinting 12/17/2008 - 82 days ago (2 months 21 days)
Last RFE: 06/12/2008 - 271 days ago (8 months, 26 days)
Last Congressmen Inqury - answered the same day "expect follow-up interview app within 60 days) 12/22/2008 - 78 days ago (2 months, 16 days)
and here are my thoughts:
If I send a notice to a DD of Orlando USCIS stating that I will be filing WOM within 30 days if case not completed, then if DD really cares the very first thing they will do is to get me on some quick interview (it will be our second one). 99% chances separate. It is obvious I am not going to go there after all that shit with my case and inquiring every month through infopasses without getting an attorney to assist. Now, the average fee for that is around $1,000. And what? if we are approved then fine if not we come back into the loop of inifity time again minus $1,000 and still thinking about getting WOM. But I just checked with FL 11th District Court in Orlando to file a case it is $325 and around 2 wks of waiting time.
I am thinking to myself why not screw the DD and just file the WOM. Whats your opinion on that??
Also may there be any additional costs regarding WOM??
After filing in the court, how does the process look like? is there a series of meeting or just one meeting who looks into your case (judge?)
How long does it usually take to finalize wom? weeks, months?
What could be possible decision on WOM? something like request for USCIS to finish the case within 30 days, or approval decision or what? Because when you file WOM AFAIK the court takes over the jurisdiction regarding your case. How can the court order USCIS to finalize case if USCIS does not have juristiction over it anymore? Is it mean the only decision can be given is to be approved???
