Just started PERM for Green Card and not much time...

Hi all,

This is my first post. I should have started my process much earlier but due to my family situation, I could start it only too late. I work for a biotech company and it has been quite supportive. Here is a summary of my situation.

1. My H1B and I-94 will be expired at the end of this year 2007. On my H1B and I-94 it's printed 'until june 2008' but my lawyer told me that my VISA status was changed from J1 to H1B in Jan 2002 (and my 6 year period with H1B is (Jan 2002-Dec 2007)).

2. There is 70-80 days of H1B recapture time (time spent outside of US). The lawyer told me they might submit a petition in December 2007 to utilize it and extend my stay here to the maximum-I didn't extend H1B before my 6th year.

3. I might have to travel to my home country or other country to add to the recapture time in November.

4. It was only 2 weeks ago (9/14/07) that we filed for the PERM/LC. Should I expect about 2 months before it’s approved?

5. I understand that there is no I-140 premium service anymore. So, I-140 process can take upto 6 months without it right? How long does PERM and I-140 process take nowadays (Bay area/California)?

6. To summarize, it seems I can stay and work until March-April 2008 with recapture time/petition. I hope I get I-140 approval before that. One question I really want to get an answer for is “Can it be done in time” Otherwise, I’d better begin to think of a plan B (going home...?). I really like my current job. Is there anything I can do? I'd appreciate any input, advice etc.
