I just spoke to USCIS officer about what to put in form I765 p.15 current status if my H-1B expired and I am using EAD, which I have to renew.
His answer was absolutely different from suggestions from this forum. If my H-1B expired, and I have pending I-485 and I am using EAD to work in p15 current status I have to put "EXPIRED".
What do you think? Who put "pending AOS"in I-765, P.15 and received EAD recently?

what don't you use e-file? Easy, save your time and money. You can still say H-1B even if it's exipred and in addition you put down I-485 pending in the remarks area (don't remember the exact wording). That's how I did for the past two renewals. No problems at all. CIS won't even bother to correct the mistakes you made on the form as I just found out I made a huge mistake on the form instead of saying my native nationality I put down USA... :p
 
I am just scared to see some computer's problem (or network) during the application. However I see that you've done it very well. An option related to add some explanation to current status looks very helpful.
Anyway, I can't say yes if it's no, it may make more problem. How bad is to say "expired"? Actually it is true, our AOS is not a status, we just allowed to stay and work by attorney general, that what he also confirmed.
How long last time it took for you to get a new card?
 
from what I see there are nothing to be scared about the computer/network/internet. You can just go to cis site and create your own account, log in, put your info in and credit card, hit the sumbit button. That's it! Nice and easy.

As regards the expired H1-B, you don't worry about anything once your I-485 is submitted or pending you are in the legal AOS status. You can't get kicked out unless you leave the US. As long as your case is not denied, you are in perfect shape i.e. your legal status in US is I-485 pending, period. You will have the same legal status as those who have the H1-B, H4 or F1 or other non-immigrant status before. Once you enter into the I-485 everyone is the same before the US immigration law.

It usually takes three months to get the new card.
 
e-filing

To my understanding, once you use your EAD, your H1B is not being used anyway, EAD takes the priority. My H1B expires Dec'05, but I used EAD and H1B is nowhere mentioned anymore. e-filing is easy. I too, was sceptical about it but I submited my files for renewal online, both EAD and I-131 on May 3rd and I-131 was approved (extended) by July 1st. My EAD took 2/3 weeks longer, as I had to submit more evidence.

After filing online, you'll receive email confirmation with your SRC#. Call the 800 number and make appointment for picture taken, biomatrics and signature to your local office.

This was my first renewal, and I applied few months early and I though if approved early I'll lose those extra times, but they issued the exact timeframe, sept'05 - sept'06.
 
My lawyer has written App for EAD on line 15 which asks for current status. I am also in the same situation, using EAD, H1 expired. This is my first renewal but that is what he has written.
 
Tangohi, you mean "App for EAD", do you know what is App?

I have applied for my 4th EAD. I always write AOS for current status. I know AOS is not a status but AOS qualifies me for EAD. "Expired" H1 does not qualify you for EAD. The NCSC is full of uninformed, poorly trained contract workers who don't care about screwing your application.

I would Write Pending AOS. Do not go by the "OFFICER" . He may not be knowing what is EAD.
Paper filing you just send the papers.
E-File has disdavnatage of going to office and againg you need to send the paers also.

Yes, I put "Adjustment Applicant" in my status during my EAD renewal in July. Got approved in 2 weeks ...
