Just got an RFE

Dear All,

I'm new to this site and I am really glad that I can get useful information regarding my NIW case here. I filed my NIW petition on December,1, 2005 with the texas center. Today I noticed that they sent an RFE to my lawyer (not recieved yet) and asked for further info! I'm really surprised as friends who applied with half my qualifications with the same lawyer got accepted without any problem!!!! Even my lawyer doesnt know what they may want! Anyhow, do you think it might be the case that just a small document is missing or they just send RFE for serious cases similar to those posted on this website!??!?! I dont know maybe a piece of document is not there rather than lack of support for being a national interest!!! Any idea?!?!?!
It's kind of funny because I got a letter in mail from USCIS as an appointment for my finger printing in 2 weeks yesterday!!!! How this is possible to happen so fast even before I-140 approval?!?!?!?

Any idea?!?!?!?

same thing happened to me also.. mine is NIW at CSC. i got the FP notice the same day i got RFE on I140... i even received a RFE on I485 for my wife on the ame day...

my 140 RFE was 7 pages.. repeating the same thing.. and thing was that i did not include any letters from National organisations like NIH/NSF/CDC etc... (though i had submitted 10 letters 5-collaborator/boss/ex boss etc and 5 completely independent.. but still RFE asked for more evidence that my work is in NATIONAL interest...

Sorry to hear that..I think you will be fine..a couple of my friends who received NIW-RFEs from Texas were approved recently.
It is hard to guess..entirely depends on the officer who reviewed your case.There may be some specific questions about how you satisfy NIW requirements.
As far as FP is concerned, it is nothing to do with I140 progress. They keep doing these things just to show that 'they are working'!!

I just wanted to mentioned that I provided 12 reference letters 6 from government agencies such as USDA, FDA, and USEPA. I have been selected as a reviewer for a journal, i was a chair for several sessions in an international conference, i was in the organizing committee of an international conference, been selected as a reviewer for a research done by Harvard school of public health and lots of other things...I am not sure if I can provide any further information regarding me being a national interest!!!!! It's really frustrating:(

Did you submit your ETA-750 Part B form along with your I-140?
 
Sorry to hear about RFE. I can understand how unsatisfying it could be when you see lesser qualified candidate gets no RFE. But there are lots of thing on which your case relies As Toxic said it can be any missing forms!! or any explaination regarding content of the letters. .....best thinsg would be to wait and watch for actual RFE.

I guess ther eis no connection with FP notices coming and RFE issued.....I-485 related stuff is taken care by independent department.

I saw you are very confident about your background and current situations - many letters from government and lots of valuable activities and so on.
Yes, it looks very impressive. And so was I, though it could not reach to the level of yours.

I got very frustrating RFE, while my colleage got approval with less of my qualification. And the content of RFE was more weird, said,

He/She was convinced that I was very excellent resources according to the records and recommendation letters, but he/she could not be convinced the reason of National Level Interest. So, he/she wanted more evidence from specified organization - my case of more letter from US Army.

I work for an organization that is one of contractor of the US Department Defense and my research funds are given by US Department of Defense. And my research area is defense technology focused on anti-terrorism. (So most of my recommendation letters came from US Army and US DoD)

I solicited and added several letters as directed and responded, to get denial letter four months after my RFE was received. And the reason of denial was almost the same as RFE.

When I prepare the documents, somebody told me too many letter from government side could be negative. I could not find any other reason.

I don't want to threaten you, but you'd better be very careful when you make RFE documents.
