Just got a letter...

....after 3 1/2 years of being stuck in the damned name check, I got a letter from the Newark District Office advising me that my adjustment of status to a permanent resident has been approved

Now here are my questions that I am hoping you can help me with:

  • My letter states I will get my GC in 6 months but I can go to the district office to get my temporary alien card. Do I need to make an InfoPass appointment for this?
  • Ironically, I just e-filed for my EAD and AP renewal yesterday. Is there anyway I can get my money back? Can I call my credit card company and request those charges to be denied?
  • My GC is marriage based, do I get a regular GC or is it the 2 year probationary card? Since I've been married for 4 years, do I just get a regular 10 year card?

You should be getting unconditional permanent residency. I wonder why it takes them 6 months for the card? I suppose you could try to request that the transactions be reversed, but my personal opinion is that you don't want to be screwing with the USCIS until you've become a citizen. (And then screw them big time with the power of your vote!) I guess I'll let someone else comment on the money reversal issue.
 
Thanks very much. I hear you on not blocking the charge, but at the same time it is $650 for my renewal which I don't need any more....lets see...anyone else have any comments, feedback to my questions above.

I checked a couple of your old posts and i have a couple of questions. I filed my 485 without having 2 years of marriage, I was stuck in the name check for almost 2 years (we've been married for almost 3 now), my name check cleared a couple of weeks ago, and i have my new FP's taken in 1 week.

Was this your case? Did you have a second interview? If you did, how far from your second FP's?

We are a little concern because my wife is going to ODS (boot camp for Navy officers) for several weeks to CT (we live in VA) and if the interview is held during her ODS, it might be a PAIN IN THE ASS for her!!!

I was in the name check for a little over 3 years :mad:

As for my situation, I gave my first set of FP in July 2004, then I got another letter in October 2007 to appear at the ASC again for a second round of FP which happened in early Nov. Then I got my approval notice in the mail in mid December...I really wasn't expecting this so it was a great surprise.

As for the interview, my wife and I had our interview in Aug 2004, but we never got called back for another interview. I just received my approval letter which said that I will be receiving my GC in the mail in about 6 months. In the meantime, I took an InfoPass appt yesterday and got my passport stamped :D

As far as your interview, did they call you back for a second interview? If not, then you needn't worry.

Call the credit card company and request they deny the charges. After all, you don't need them, and USCIS can afford to function without your $650.
 
Easier said than done my friend. I was advised by two lawyers not to do anything since the USCIS can turn around and charge you the full fees and and additions $70 fine per application. Also, I read through their refund policy and its pretty tight. The way I look at it is, if someone said give me $650 and you get my GC - done!
 
Congrat... looks like two people with similar dates to mine got their GC... I hope I do soon... I tried everything (including a WOM suite that got dismissed by the judge) ... I gave up trying but I still have hope that the nightmare is over sooner rather than later.

No, they haven't, but i was asking because when i had my first interview in 06 i didnt have 2 years of being married, i was ASSuming that they needed to check that we are still married since i should get the permanent GC now.

But, there is no issue anymore, after long discussions, my wife and I decided that she is going to join the Navy in June, so.. no boot camp for a while ! ;)
