Hi,
I got stuck in Canada for 6 weeks with administrative processing. Before I go for H4 stamping for my wife, I will have only 2 pay checks (I read, generally u need 4 continuous pay checks).
My questions are...
1. Is it even legal for employer to run pay checks during the period I am stuck in Canada...?. Technically I didn't have H1B for 6 weeks. My earlier visa is cancelled on the day I attended the interview and got a new one only after 6 weeks. If it is legal, I can request my employer to check pay checks...!!! or would a letter from employer saying that I took unpaid vacation helps...??
2. If employer cannot run pay checks, would a letter or something from employer explaining why I didn't get paid for 6 weeks helps for H4 stamping...??
Appreciate your responses.
