Just called IIO regarding I-140 REDO

She told me my I-140 application is being treated as a new case instead of emended even though my attorney specifically noted as amended petition on top of the application.

She said, she would take care of it to attach it with my 485. I am not sure how honest she is.

Lately, they are having trouble in sending receipt notices. So, if any one waiting on receipt notices don\'t have to worry. Just call IIO and get you case number based on your last name.

Do you mind calling INS and ask them whether your case has been entered as new or amended?

Also, ask them whether your 140 and 485 are together. I feel it is important that you call and inquire about your case. Talk to call different people and make sure things are in place.

although my case is different from yours (since i\'ve proactively filed for redo as against rfe), i\'ll check with vsc about my case tomorrow and let you know.

Hello 485notdone, Mailed on 6th Oct by Fedex. My atty did n\'t inform me. I got to know yesterday that they had recvd the 140 receipt. But, I did n\'t ask them when they recvd it.

Hi Suri, Called IIO this morning. Got the same response. i.e, 140 is being treated as "new". Also, she said that it is attached to the 485. She will send a request to include it in the automated system (for 140 it says "case not found" now). To my question on how long the wait, the response was "no idea". Just "wait".

I thought they record in their database only if you talk to rep. Do they record even the call to the automated system? She knew that I checked last night.

Guys, we are getting conflicting reports. Some times, I wonder whether IIO\'s really know what they are doing and talking. Thanks to both Venkat and Despo for calling INS.

Venkat don\'t worry about "case not found" I have seen someone reporting his 140 approved that was file in end of sept.

Despo, if you don\'t get your receipt by end of this week, tell them you didn\'t receive any notice and they will give you the case number.

Generally, I noticed women iios are better than men. I called couple of time in the morning and I encounted men IIO and stoped calling in the mornings. These days, I am calling in the afternoon after 3pm est.

I am planning to call INS tomorrow. I will keep you posting.

I tried to get my receipt# but the lady iio said i should talk to my employer and get it from them. I was able to get my 485 receipt# on phone -- do they treat 140 differently??

Aqua - The difference is that on the I-485 you are the petitioner, while on the I-140 your employer is the petitioner.

Folks ... I called VSC again (got thru within 3 tries)and was lucky to get a good iio to talk to. here\'s what she told me ...

1. eac# 01-009 (rd : 10/6 nd : 10/13)
2. it will be treated as a new I-140 and they are currently processing cases before 7/7
3. once it is approved, it\'ll be automatically attached to my I-485 because they are tied by the same A# and I won\'t have to follow any procedures to re-send the approved I-140 to be included in my I-485.

Somehow #3 sounds too good to be true ... but then the test of a pudding is in eating it...

Aqua - The earlier post by Jay-ram seems to conflict with what the IIO is telling you, about your I-140 being treated with other new I-140s. His case seems to be very similar to yours, and was approved in a few weeks.

I got similar answer yesterday as you stated in 2.

But, what I really don\'t understand is why do they have to treat it as new. Even if they treat it new why do they have put it in same que as other regular 140s.

I have enough pudding and I am sick of pudding now.
