Just AP to enter in US ? or AP and EAD

Hello

I have couple of question in my case. I belive someone will try to give me all answares.

My visa on passport had expried but I have valid 797 until 2011. I-495 is panding.

Since its very hard to get stemp on passport I think I have to use AP to go to outside of US.
1) Can I take AP only with me to enter in US. or EAD and AP ?
2) Do they ask paystub ( Or any question )with AP when we enter in US?
3) Once i get back to US, what would be my status ? H1b or parolee.

Your help would be appreciated.

1) You are required to have a valid passport and AP to enter the US. The EAD has nothing to do with travel, it is only a work authorization document. It is not a visa, and does not confer any status on you.

2) They can ask anything they want. Experiences vary. Many people don't get asked anything, others are asked where they work etc etc. If you are worried, then have a letter of verification of employment with you, although again, it's not required.

3) Your status will be parolee. However, if you were in H-1B status before you left, and you intend to return to the same job, and your I-797 is still valid, then you can continue to work there without an EAD. Once your I-797 is close to expiring, you can apply for an extension, and when that is approved, you will be back in H-1B status.
