Thank God, me and my husband\'s cases are approved today 2/26/02.
PD: 11/99
RD: 6/10/01
ND: 8/15/01
FD: 11/29/01
AP: 2/26/02

I have to fly back to China this Saturday. I do not have Advance parole and I have not got notice, no stamp yet. Do I still have to apply H1B visa in China?

Many many thanks to everybody here. Without you and your courage and help, I could not go through all those years. I wish all of you have your cases approved soon.

it\'s not like that for Chinese

Indian and many other countries\' citizens can get multiple entries on H1 visa which is valid for a period of 5 years. That\'s not true for Chinese. Nearly every time you need to re-apply for H1 once out of US.
 
You are safer with Advanced Parole. I don\'t think you have to go to the Embassy....

Check with an attorney and go to your local INS office. If there is an immdediate need to go they will give it to you. Its pretty routine and so worth the trip to your local Center.
 
How about consulting a lawyer!

If you really have to go back now, the best and safe way maybe is asking a opinion from a lwayer.
 
Since your GC is approved..

As far as I know H1 / AP will become void once GC is approved. You have to get your passport stamped before leaving.

The case is different if you are already outside US when your GC is approved.

I don\'t think you can get advanced parole since your I-485 is already approved. I would wait until you get your passport stamped. If you cannot wait, you should consult an attorney. Don\'t use H1B to re-enter the US without advice from an immigration lawyer.
 
How long will it take to get the approval notice?

My lawyer does not suggest me to go at this time. So I have to wait to get my passport stamped. I wish I can get it done by this Friday because my ticket is this Saturday. But I know it is not realistic.

You need get psaaport stamped. No way around

Once I 485 is approved all the existing visas will be cancelled. Advance parole will not be issued. If you have any existing advance parole those are also cancelled. The only way is to get passport stamped. Talk to a lawyer. I know this thing from Sheela muthy chat session. Check in murthy.com previous chat sessions.
