Hi, friends!
I am in a very bad situation now. Need some assistance and advice!
So, I applied for the green card (family based through marriage), recently got RFE (request for evidence). My husband's income (our income) doesn't meet the requirements. It is very difficult for me to find a joint sponsor because no relatives or close friends here, I tried it by other (people I met here) but no result. So, my husband doesn't have any property in America. I don't have any income or property to help him to meet the requirements except of a car in my country but I am not sure if I can use it. I don't know what to do. May be somebody has the same situaton.

Actually, my mother has some property in my country (not include where she lived) and i will inherit it later, now she let my live and use these at any time or sell it. But I don't know if I can use or mention these property in my case because I am not really the owner I only have the right to use or sell it at any time.

His income is $10-$11K below the required amount? That would be an income of $7-$8K if your household size is 2. That's strange, as it's below minimum wage for a full-time job. If he's actually earning more but hiding the rest of the income to avoid taxes, you and he might have other problems.

I assume your husband is a US citizen? If yes, your combined eligible assets would need to be 3 times the income shortfall, so that would be $30-$33000.

You can't use that property owned by your mother unless your name is added to the title, or it is sold and the money given to you. You might be able to list the car, but you'd need a certified appraisal along with evidence of how much you owe on the loan (or proof that you own it outright, if there is no loan), and only the net after subtracting the loan balance can be used.

What about cash and savings accounts, anywhere in the world? Jewelry?

Thank you for all information. So, I can list the car although I had only one automobile? (There is the information in instructions to I-864 that a car may be listed only if the person has more then one). As for cash or savings, I don't have unfortunately any other assets, nothing at all, that's the problem :(
May be my mother can add my name to the title, that will be great in my case because the car is not enough!

Yes, there is a sentence in the instructions saying you can't list a car if it's your only one. However, there may be an exception if the car is in another country. But anyway the car probably won't be enough, as $30K is really expensive for a used car.

See what you can do to get your name added to the property in your country ... hopefully your country doesn't impose a large tax or have a long bureaucratic process for that transaction. Also note that if the property is jointly in your name and hers, you'll only be able to claim half of it. And that's half of what's left after the loan balance is subtracted from the appraised value. So it still might not be enough after all the math is done. Your husband might just have to switch to a full-time job or get a second job.

Note that pensions would count as income for this purpose. So if his work income is so low because he's living off a pension, the pension can be combined with his work income.
