Joining bankrupted Company

I am working with a bankrupted company as Contractor. Now this Company forcing me to join them as employeer or they will release me


I am still on H1 with my sponser Company and I have my EAD card. but never used.

So if I join the bankrupted company using my EAD card does it effect my Green Card Process. did INS refuse my GC because it is bankrupted Company

As I heard this company will go out of bankrupcy at the end of this year.

my GC details is

RN MAY 6, 2002
ND MAy 7, 2002

my EAD card will expire on August 2003, but I filled for renew.

It is good to do some homework and search this forum for situations similar to your own. Self help is useful, not just because it saves us a lot of time, but also answers your questions better!

With that said as long as you meet ALL the following criteria you should be okay:
1. 485 has been pending for 180 days or more.
2. You will join the new company on a salary atleast equal if not more than what is stated on your labor.
3. Your job description is the same as stated on your LC.

If the above 3 points are met by you, then you can file AC21.
