Hi All,

Many of us might have our labor approved thru PERM or Backlog center or in the process of getting labor certification but the terrible truth is even after labor approval & I-140 approval we cannot file for I-485 because of Retrogression of PD - Priority Date. As per the current June bulletin from the US department of state, the priority date for EB3 is Apr, 2001 and for EB2 is Jan, 2003.

It might even take years to file our 485, God knows when PD will become current. As a temporary measure if we are allowed to file 485 without PD being current, there are lot of advantages.

* The applicant and their spouse can get EAD.
* The Dependent can go to work.
* NO need to file a H1 for the dependent spending around $2500.
* Can change the employer in 6 Months for a better Job.
* Avoid the pain of H1 extensions & stamping every year.
* Travel freely, Can go and come into the US any time with Advance Parole.
* Move up in the career.
* And lots and lots more..........

Currently US Senate is debating the Immigration Reform Bill, This is our last chance to make an impact on our life in the US.

IMMIGRATION VOICE HAS DELIVERED, NOW IT’S YOUR TURN.


Senator Arlen Specter bill is accepted in Senate, some of the provisions are

1. Lets everyone file 485, if their labor is approved even if their priority date is not current.

2. Remove the hard limit on countries so that over-subscribed countries like India and China are allowed to use visa numbers that ARE NOT USED by other countries with low number of applicants.

3. STEM applicants would be allowed to be exempt from cap even if they have not been working in exactly the same discipline as their STEM master’s degree. This will be a huge relief for many in EB3 and majority of EB2 applicants as they would become exempt from cap.

This achieves the goal of IV, for the time being as far as Senate proceedings go. There is a lot more to do, as the House-Senate conference proceedings are going to be on final consequence to this bill. We have our work cut out in front of us.
