First of All ,

I would like to thank Joef and the others who gave me guidance on the issue listed below , but I would like your opinion on this one please :-

After thanking each and every one of you for your valuable advise and experience sharing, here is my case hopefully someone will in this community help out with ideas and advice.

I already applied for my citizenship; I don't have any violation except one, which was before even I got my GC.

I was unfairly issued a summon by police for disorderly conduct and had to appear in court, NO ARREST, NO FINGER PRINT, NO PHOTO was taken of me, except for the summon and to appear in court, I did appear in court and explained to the judge the whole issue, the judge then DISSMISSED the case.

I later on obtained court disposition and in the letter of disposition my family name is misspelled, I spoke to the court clerk to correct the name but I was told that since the case was OLD and DISMISSED, the file is now sealed and that there will be no mention in my record of any charges.

Can you please advise me if i did right by marking "yes" for Question 16 and 17 on part 10.D. Good moral character of the N400 form.

Let me rephrase your own question: "Was I right in telling the truth in Question 16 and 17 on part 10.D. Good moral character of the N400 form?"

You know that whether CIS will find the records under your correctly spelt name is obviously irrelevant for the answer.

N-400 is not a game of what CIS can find out, it's about telling the truth about yourself.

The issue is that the citation was not within the 5 years period and the confusion between cited and charged; yet the case was dismissed any way.

My question was which part has to be answered "YES" and which part "NO"

It might sound a GAME to you, but as far as I am concerned it is not.

Still you did not contributed in any answer yet, apart from rephrasing the already obvious question.

I am surprised that you still do not know the answer after rephrasing the quetions. Anyway, I'll continue with the Socratic methods, b/c I do think you have all the elements to know the answer with absolute certainty. It is easier for me to give you the obvious answer, but that way it just be the opinion of a stranger.

The actual two N-400s questions are:

16. Have you ever (in bold in the very form) been arrested, cited or detained by any law enforcement officer (including USCIS or former INS and military officers) for any reason?

About the time period: Do you read 5-years or EVER?
About citation: You wrote that you were "issued a summon by police for disorderly conduct and had to appear in court"
From dictionary.com: Cite means "To summon before a court of law."

17. Have you ever (in bold in the very form) been charged with committing any crime or offense?

About the time period: Do you read 5-years or EVER?
About being charged: You must have been charged because otherwise your case could not have been dismissed. If you read your letter of disposition, you'll see that the charges are listed there.

No problem. There are two issues behind your concerns. You have to report it, but it will NOT material in the adjudication of your case. However, willfully omitting it would be a factor in evaluation your moral character. You did the right thing.

BTW, I had a similar case and my interview was impressed by my sincerity. It proved a good moral character by not hiding it, although I knew he could not possibly know about it.

Another consideration is that a lie in the N400 can haunt you years down the road. Why have this Damocles sword over you all your life?
 
Absolutely. A lot of people have lost citizenship even afte 40 years for hiding their association with the Nazi's when they immigrated to the US after world war 2.
