Johny Cash or some one please

Can the CIS deny my citizenship application if I enter the country on B1 VISA and it expired 8 months before I got married to US citizen and I got my green card .If yes why they gave my green card to start with.and that means I will never be able to apply for the citizenship.
My interview was yesterday @NYC office and ended up with dicision will be mail to you .The officer never mentioned any thing about my entry or name check she just said I have to review the case and it's late now and she looked at the clock.
I did have an arrest on my record but the case was dismissed by the court with no dael or any thing just dismissed . She told you will get an answer before FEB 1.
She did have me sign papers and also sign in the front of my two pictures
I really don't know ,I feel that I did mistake filing for citizenship ,I never lied about any thing .

thanks for any help

It sounds more like my experience. They never question anything during the green card process, nor during the removal of conditions. I think she asked to review the case just because you had an arrest. but that doesn't mean a denial.

I think you would be fine, you didn't lie , and she made you sign the photos , and that's a good sign!

Please, you may find my thread helpful, you may want to talk a look at the thread "I got denied please help" and "Decision is overturned Sony-yes"

Good luck and keep us posted :)

It seems like they wait for you to apply for citizenship then try to get you somehow.what happend to these interview you had before .no body bother to look at your entery visa.if they allow you to adjust your status after being illigal they have to accept it when we apply for citizenship .I think that make sense.

Is there any issue for citizenship applicantion, if a person came on B1 visa - officially did business with company on B1 visa - later on got an opportunity within US with another employer and converted the status to H1B - got another better job and obtained 2nd H1B - got employment based green card through employer who sponsered 2nd H1B - now applying for citizenship after 5 years. No problems during Green Card process. No criminal record. I read on some forums than visa status conversion (B1 to H1) might be issue.

Please advice :)

well.. did you overstay during anytime in US?

Were you illegal for those 8 months??

No overstay. ( Not out of status anythime.)

then i guess you are ok because it is normal change of status from one legal status to another one.

i was a F1 then I found another job, and got the first H1, then found another job so I got 2nd H1, and etc etc.. finally I applied my green card based on my 3rd empolyee.

All the issues/concerns that you have mentioned above were already settled/disposed when INS granted you a green card; otherwise INS had not granted you a green card at first hand. The only issues that could be matter during the time of naturalization are-pre-intend (which won't happen in your case because you entered on B-1 visa) and any lie that you might have told on any immigration application such as an application for B-1 visa and AOS or anything else. If INS finds that you had lied about a MATERIAL FACT then they will revoke your green card and will place you on a deportation proceeding.

The reason for the officer not to make a decision on your application right on the spot was-Officer was in rush. Who knows she might have a date or she might need to pick up her child or something like that; otherwise why she even arranged an interview for you without reviewing your file. Doesn’t make a sense to me. And what did she need to review when you have a DISMISSAL order with you on a criminal case? Her action was just a BS.

I think she was a rookie officer, who decided to make sure she makes a right decision. Thus, when she realized that you have an arrest on your record, she wanted to make sure to get an approval from the supervisor on your case than approving by her own. Some adjudication officers do this to play safe, especially rookie ones.

I don't think you should worry about it. You will receive an approval and Oath letter very soon as my basic instinct tells me so.

Good Luck!
