HI guys

I already have questioned you and you guys have answered with patience, I appreciate all your answers. I have one more question, that is


I am a Schedule-A PT. My 485 RD with VSC is Nov 29 2004, My I-140 was approved on May 4 2005. I am in a process of changing jobs, my start date of the new job is Jan 16 2006. I going through AC21 process since my 485 is still pending. My last day on my current job is Dec 30 2005. I have 2 weeks of paid vaction with my current job which i am planning to take after i leave the job, my job will pay me for the 2 weeks as I am eligible for it, so I am planning to join the new job onlyby Jan 16 2006. My question is do I have to file the AC21 before I leave the current job (that is before dec 30 2005) or to file it after i start the new job, because in the next 2 weeks i wont be working anywhere else, to be on safe side i already got the AC21 letter from my new employer, but unfortuantely my attorney is on vaction, he will be back after Jan 2nd 2006, so in this case what should i do, if I dont file AC21 before i join the new job (note: I am on H1B with my current job, the H1B expires only by Aug 2007) will my status be in trouble. Kindly help me in this aspect
 
if u r not transfering H1B with the other company then its a given u r using EAD. As for using AC21- it can be any time even after joining the new company. jsut make sure u do before I485 is approved. (no way of knowing it - so applying ac21 soon is good)
other than this reason - it does not matter when u apply for AC21
u will be in payroll with company A until ur paid vacation and then switch over to company B
