Hi,

A friend of mine lost her job on H1B in March this year & since been trying for job
in USA. Now she is thinking of immgrating to Canada. Can it be possible. She
might be out of status & staying illegally in USA for last 3+ months. Will she get work permit in Canada ?

Please reply....

It will probably be better for her to apply for canadian immigration rather than trying to get a work permit. It will take sometime but it is a guaranteed thing. Canada and USA dont share immigration details so overstaying here and being illegal shouldnt be held against her provided she doesnt specify that in her application.

I think now it may be difficult. Before getting my landing papers I was asked to send in a proof of legal status in the States.

us status

In my opinion staying illegally in the US (anywhere for that matter) is insanity for an educated individual.

even at the quickest, immigration will take a looooong time.so to wait 4 something of such long duration with squirrelly status is risky in the extreme.

If someone can get a job in Canada I think it makes much more sense to try the work permit route. Even better to try the work permit route from the home country and not the US.

If she stayed in the US legally (in status) the first year, then it won’t matter if she is out of status now. She can still apply for PR in Canada. If her stay was less than a year before she lost her status, then it could be a problem.

Be careful - I've heard conflicting information. While US and Canadian immigration are separate things, I've heard lawyers state that some people evaluating applications consider illegal to be equal to criminal, and therefore not a good thing.
