Job zone vs perm audit

Hi, I was speaking to one of the attorney, they mentioned, if any O'net code, which lies in JOB ZONE 4, is used for a perm filed under EB2, it would get audited. Most of the IT job codes are now in JOB ZONE 4, but most need considerable experience, especially architect, system analyst jobs. Do these jobs still need to be filed under EB3? Attorney specifically said that if job zone is 4, even though person is having excellent experience, case would get audited for employer to justify the need. Any idea? I need to start a new Perm, I don't really want to file under EB3

The maximum education and experience requirements a job zone 4 occupation could ask for is Bachelors plus 2 years of experience OR Masters plus 0 years of experience. He is absolutely correct about all job zone 4 occupations are EB3, if it is pushed to EB2, then yes case could be subjected to business necessity audit
