I am working for Employer A and my 140 is pending with this employer. My H1b 6 years time will be over by Feb 2006.
Q1: Is it possible to get 7th year extension now from another employer, Employer B using this pending GC?
(Employer B is not like our Desi Company and may not be interested to go for loop-holes? So, I am bit scared. Please suggest?)
If Yes,
Q2: Do I need to get my new labor from Employer B before Feb 2006 to get my 8th year extension? Or I just need to have 365 days from the date I apply for my PERM labor?
Q3: Do, I need to have copy of my labor from Employer A to apply my h1 B extension/ transfer with Employer B? What else I need for proof from Employer A?
Q4: Please let me know, any known issues?
If no,
I will apply for 7th year extension and I may get it in few months (technically, I will have 1 year 4 months valid H1 B period including 7th year when I get my extension). Once I get my 7th year extension, I would like to work for employer B and want to get my Green card sponsorship.
Q5: If I apply for H1 transfer from employer B, will I get 1 year 4 months or will I get only just 4 months in my new H1 from employer B?
Q6: If I get 1 year 4 months, to be eligible for 8th year extension with new employer, employer B, will I have to get my new labor in next 4 months(Feb 2006) or 1 year 4 months?
