Is there a way to find out what was filed as job description for Labor Certification ? Any way to find this out other than asking the employer (lawyers) ? I am not sure what they stated as job description when filing the labor papers

The ETA-750 form submitted for LC has the job description in it. You should have signed part B of ETA-750, part A has the job description.

thanks for the quick response....

will the ETA-750 part be available from any place other than the employer ?

I would think these douments should be public records -- that's the whole purpose. No sure if I can find out what the description was other asking the employer. I do not want to ask them since they might think why I am requesting this information. In my mind, it's just something I want to/should know.

Thanks

u can get it from either of three places:
1. Your local DOL office, where ur LC was initially filed
2. Your regional DOL office, where ur LC was finally approved
3. BCIS

You would need to file an FOIA (freedom of information act) request. BCIS has a form for it, whereas DOL only requires u to fax/mail a letter.

In my opinion, it is easiest to get it from regional DOL office as the local office does not has all the info, whereas anything to do with BCIS can be painstaking. Call 1-877-US-2JOBS and ask for the FOIA officer/regional DOL numbers.

goodluck!

If your labor cert went through RIR, and you remember the date the advertisement was published in the newspaper, then maybe you can get it from any library which keeps newspapers. The ad should have the same description as your LC application.

the scoop on your LC

you're not gonna believe your eyes when you see this, and used to be that they actually had your name there too, which they have mercifully now hidden, but check this link out:

http://www.flcdatacenter.com/casesearchperm.asp

it shouldn't take you much to figure out which is your case, given the decscription and dates.

also, find out what your colleagues proffered salaries are on their LC applications. knock yourselves out!

job description in I-140

I just checked copy of my I-140 and found out that job code and description are on it. If you have a copy of I-140, you should be able to find it.

I used a substitute LC, so I also have a copy of ETA-750 B when substitution was filed. The job description on ETA-750B and I-140 is the same.

unfortunately I do not have a copy of my I140 application. I do have a copy of approval notice. I will try some of the methods suggested like the website link or writing to the DOL office.

Thanks much.

wanted to reiterate .... great information sharing folks !!!

A few points....my application did not go through RIR and I was crazy enough not to make copies of every document I was signing :( It's just something one should have at all times whether or not you actually need to use it.

Thanks for the great information. I got my LC record. The problem I have is that, my company used the substitute LC. I dont have I-140 application, but only the approval notice. I looked at the LC applications my company filed on that date. Of them 4 are programmer analyst and 1 Software Engineer. My original LC is Software Engineer. Is there a way to guess, of there 5 which my company might have used for my LC for substitution. Any thoughts.????.
There is a very slight difference in these two job descriptions. Is it going to cause a problem If I use AC21 with out knowing the exact code and description.
I would appreciate your opinion on this issue.
