I have question about Job description in Labor certification.

I am on H-1 for last 3 years and want to apply for LC now, Should my job description needs to be exactly same as H-1 job description or can we add some more duties and responsibilities to it? Since LC is for future job, my understanding is we can add some more in job description. If so, can it be problem at I-140 stage? Can they question about it ?

Also, the advertisement for RIR needs to be very generic or it can have some special requirements? This is for Chicago.

If we advertise in newspaper, etc. now, how long we have to wait until we can apply to labor department. My understanding is you need to show the efforts for recruitment within last six months, so after say 2 months of advertisement, can we apply ?

Any insight will be appreciated,Thanks.

Job description in LC is about offered job. It may or may not match with your current H1-B. As long as as duties mentioned are normal for offered position, one can add them in Job description. Also make sure your skill/experience satify whatever requirement you are stating in Adv.

Regarding content of Ad. : Try to place an adv which matches the job description and requirement (also satisfied by your skill/exp) but make it look like generic.

Usually placing 3-4 Adv in a news or any other print media depending upon offered job with in a span of 45 days is OK.

Hi USNYCUS,

The job description specified in my LC application doesn't match 100% with the RIR paper ads.

In otherwords,my job descr includes few extra items(i.e skills/tools) that are not listed/advertised in my paper ads.

I appreaicte your comments in this regard.

Thanks
