Job change on EAD and dependent's status

Gurus,

Mine , my wife's and sons 485 cases were filed in Jan2002 first week.
Me and my wife have EAD's.
Right now I am using my H1(extension after 6 yrs) which will expire on 3/31/2003.
My wife and son are on H4.

My questions are

1)If I join a new company on EAD then I will lose my H1 status but what will be my son's status who is on H4 but do not have EAD?

2) Do I need to notify INS when I change job on EAD while waiting for 485

3)Does the H1 (extension after 6yrs) becomes invalid if the 485 is denied ?

Please advice.

Thank You in advance

I don't have personal experience, but here are my guesses until you get an authorative answer from someone experienced:

1. Your son's status should be OK - "adjustee of permanent resident status."

2. Ideally, yes. But practically, it depends upon your risk taking temperament.

3. No. If I-485 is denied (God forbid!), the "written decision" from the INS will give you some time/date to leave the country. You are OK for the period beyond 6-years till the period you leave the US as directed in that denial notice.

Best wishes,

Jigesh
