I'm on currently on H1b (NO EAD). I'm applying for another job with a different company and came across the below question in thier Job Application.

If hired, can you submit verification of your legal right to work in the U.S.?

Should the answer be YES or NO?

I'm also required to acknowledge the below statement as part of the application.

I am aware that, as a condition of employment, if employment is offered, I must be authorized to work in the U.S. and demonstrate that authorization as required by the Immigration Reform and Control Act of 1986.

As it stands, you do not possess a legal right to work in the US except on the H-1B associated with your current employer. Most employers have that question to find out whether you are a US Citizen or a Permanent Resident.

Since you are on H1, your future employer will have to file for H1 transfer before you can begin to work for them. You should answer YES and sign the statement.
