I have a friend who has just got LC certified and is about to file I-140. Her husband has been out of status for several months last year. But he did filed 245i by himself. Also, for the past of two year, She filed my tax returns as Head of Household (including only she and her daughter) and he filed his own. My question is: Will there be any problem if she include him in her I-140 and I-485 application? Do they need to submit tax return with I-140 and/or I-485 application at all?
