One of my friend used to work for a big 5 (Company A), and is currently on 8th year of H-1B. He was unable to apply for I-485 in 10/2001 due to the fact he took a huge paycut. However the company retaind lawfirm found another LC, and filed I-140 in 12/2001 using substitute LC, which was approved in 04/2002.
Based on the I-140 approval he filed I-485 in April 2002 (Receipt date 04/25/2002) along with I-765 and I-131. EAD and AP were approved. Another company (Company B) purchased company A, in Oct 2002 Company B took over all of the H-1B's etc. etc.
In October of 2002 Company B filed an ammended I-140 which is still pending. He has two offers one offer from California and from a big pharmacuetical fim in IL. Ofcourse he will have to file AR-11 and notify VSC with his new address either in CA or IL whichevr job he decides to take.
It's been over 365 days since I-145 was filed, can he switch employers without any problems from BCIS, and get his I-485 approved. Yes, the salary and the job description are the same. The only change will be a different work location.
