My 485 approval has been transferred by VSC to Houston local BCIS office for an interview. It seems Houston BCIS office takes forever to just schedule an interview. I was thinking about a couple of options,

1. Relocating to a different city . In this case How long do you think it will take for Houston office to transfer my file back to that citiy's BCIS local office

2.Opt for Consular processing at this point.

Details of my case:

I-485 filed in Nov2001
Transferred to Houston - May 2003.

I was laid off 4 months after filing for 485 and not intimated INS. Working on EAD.

I doubt either course of action would be any quicker since BCIS in Houston would probably still have to act and transfer the file.

My I-140 has been approved & want to file 485, AP, EAD.
I do not have a birth certificate. I got 3 affidavits from my mother, father & uncle. I am not able to get Non availability certificate from my place of birth in India. What is the alternative solution. Pl. advise.

just file the I485 with the affadavits you have in hand and you can give them one or two more affadavits from a close relative when they issue a rfe (long time from now)

Hi SP29201, Jim & other experts,

I am also enclosing 10th class & 12th class certificates having Date of Birth on them, in addition to 3 affidavits as supporting documents.

I can submit additional two or more affidavits when the rfe is issued. How long normally does it take to see a case once we submit & issue RFE.

Does this in anyway affect or delay obtaining EAD or AP or finger prints.

I am new to this forum, Pl. advise.

Why can't you get a Birth certificate from your native place? Contact your local municipal office to get one. If they don't have records, they should be able to give you BC based on your 10th certificate.

Hi ar888,

for some reason the concerned officer in municipality of my place of birth is not accepting 10th class certificate to issue Non availability certificate(N.A.C.)& not co-operaring. Tried through 'all means', but the person is afraid to issue.
Problem is they have records of my actual date of birth. But the date of birth on my class X is different. Date of birth on Passport is same as X class certificate. N.A.C. required based on Date of birth on Passport.

Any alternative solution other than Birth certificate or Non availability certificate? I need ur suggestions & opinions.

Affidavits should work fine in my opinion. Are you applying in person or taking the help of an attorney? Better talk to an attorney.
 
I agree, create an affidavit stating the efforts that you have taken and the results. Get the affidavit notarized and submit it. See what BCIS says. If they issue an RFE, you need to again explain the situation and I would send yet another affidavit. Note that an affidavit must be from someone with personal knowledge of the situation and must be 100% truthful. Careful wording may be important to accurately express what happened and only state exactly what the affiant personally did.

If an attorney can convince a court in India, you can get a court order to register the date of birth.

The municipaity will register the new date and issue you a certificate on the basis of the court order.

All depends on how convincing the story to the court is.

It has been done before, but for cases where no records existed.
 
Hi Jim

My 485 approval is still pending @houston district office for an interview. I have got married last week and I understand that I can still apply for my spouse . The question should I send my wife's appln to Houston ot to VSC from where it was transferred to Houston. Appreciate all your help
