My H1 with the current employer is going to expire in another 6 weeks. Because of the economic situation my employer drastically reduced my salary, which is not sufficient to an H1 B employee.

I wanted to file an extension. My employer is ready to show a higher salary for H1 B extension.

Is my very low salary pay stubs sufficient for my H1 extension? Or Is INS going to send me a RFE because of low salary pay stubs?

Thanks in advance!

Illegal

It sounds as if your employer has no problems committing fraud. This would clearly be immigration fraud. INS will give the employer a very hard time about it if the catch the discrepancy.

You and the employer would be taking a serious risk.

Thanks for the info, what if?

Does the amount on pay stub matters if some other employer ready to give a job offer and apply for H1B?

Maybe

But you may be able to successfully argue that you were working and being paid, therefore you were in status. If they want to fight about the illegally low payments they should take it up with the former employer. In fact, you may want to retain an employment law attorney and bring suit to recover the unpaid wages.
