Jim and other experts - Urgent help needed

I was on out of status (H1B visa) for 45 days. I got a job now and asked the company to do a H1B transfer with premium processing. But the company wants to apply for a new H1B since I was on out of status.

What will be the disadvantage by applying new visa rather than a transfer? My old company did not inform INS.

Appreciate your help.

There is a no such process as a transfer, you will need to file a new case any time youn change jobs. Perhaps they\'re saying that they do not want to file a case while you remain in the U.S. They will want you to obtain your work authorization at the consulate of your home country.

If this is the case, and you have only been unemployed for a short time by your previous company and your previous H-1B does not have an expired I-94, there is a good chance of filing the case while you remain in the U.S. w/o having to go to the consulate of your home country.
