hi everyone i am new to this forum, i applied for waiver via state 20 program, now its in I-612 stage in texas center AD 1/29/2003, date currently running is 9/17/02 since few months its not moved
1.is there any way to speed it up( my health center is reqeusting senator to write letter), any way to know anticiapted time
2.my wife is on J2 visa , currentlyhas EAD till june30th,2003 but she is tranfering to another state and program and i was hoping to get my waiver approved and get her started on independentH1 from the hospital
3.now we are in fix, i did not apply for the extension for J1 (lawyer said that once waiver on I612 stage ECFMG will not extend the contract for the third year of my fellowship) is it true, is there any way out, i am looking at 1st july without any job and money
i will appreciate any suggestions please

One thing you can do, is to urgently apply for NIW for you including your wife as a concurrent filing(I-140,I-485, I-765). INS approval of waiver is necessary for NIW to be approved, but you put a covering letter explaining how state and DOS has approved it and, you are waiting for INS approval. Also could attach a senator's letter for effect. What this will do is to give you a legitimate status ( having applied for I-485). They may ask for a RFE for your I -140, but buy then you should have the waiver. Also, very likely you and your wife will get EAD in 2-3 months which will help your wife tremendously. You need a five year contract for NIW

Congratulations on approval of J waiver through state corad program.U cannot apply for extension of u J once u have filled for ur waiver if u file for extension ur waiver will be revoced so please donot do that.
Tell ur lawyer /or if doing ur self(Idid my waiver on my own)to apply for H asap for u and if ur wife has done step 3 to apply for her H one doesnot need actual approval of waiver from INS to get H visa.if she has not cleared her step 3 then as hasitoxicosis has mentioned apply 140/485/765 asap as then she can start working as soon as her EAD is approved it might not take long as it will be extension of the EAD and not a new case.
our group hired another j early this year as per my sugestion to him he did what excatly i mentioned and he got his H about 10 days before he got his approval of J waiver from BCIS/INS as his j was approved form state corad program
