Hello Jharkhandi

When an employer substitutes a labour for other employee, do employer need to re-advertise for the same position before substituting the labour for current employee.

What exactly INS look into labour substitution cases other than education/experience/salary.

I appreciate your advise on this, My friend needs this ASAP as she is planning to go for this.

Re-advertise is not needed for labor substitution. LC has already been approved based on ads placed on date MM/DD/YYYY and no suitable match was found for any reason on that date.

Typically education/experience/salary is the only point that is looked for. Your frd should have same education and experience on date MM/DD/YYYY as was mentioned in the LC.

My only suggestion would be get a good lawyer as substitutions cases are always unique in one form or other. Many times a good lawyer can make it look smooth.

You proved it again, You The Man. She has seen the approved labour(ETA750) what she told me is her education/experience/salary(more) matches.

She is very frustrated as her 6 yrs H1 will be over Dec 2004 and very much worried as HOW MUCH TIME DOES IT TAKES IF SHE FILES 140/485 together, What I heard is she should be getting her EAD in 90 days, correct me if iam wrong.

Mostly implemented in financial sector. GERM software will work for LCs.

my Boss for Assur INC. He is the whole and sole owner of our company. He is the father of GERM Software.:D :D :D
