I am a J2 visaholder staying in USA with my husband(the J1 visaholder) and an infant baby for more than a year. While coming to USA for the first time in June 15, 2011 we got our visa stamped altogether in India. Our visas were valid for one year. Now the visa has got expired but my husband (the J1 visaholder) got an extesion through DS. Now I want to visit my country along with my baby. My husband will stay here in USA. Will I be able to reenter USA with the valid DS? Is my visa restamping required? As i am dependent visaholder then , when my husband has got his visa expired(and staying in USA with the valid DS), will I be able to get a valid visa without the physical presence of my husband back in India? What are the rules and the law?
please suggest how do I proceed?
