i am presently on a j2 visa. am planning to apply for a residency next month. i wanted to know if i can get an h1 visa if my program is willing to sponsor it.if yes, what would be the procedure for it?

if i cant convert to j1 and start residency on j2, what if my husband`s j1 expires in a couple of years and he doesnt get a waiver and my residency is left incomplete still? can i still continue it on j2 or do i need to change my visa status then or will i have to leave it incomplete?

please do give appropriate guidance..any help appreciated greatly..

thanks

#1- your j2 status expires when your husband's j1 status expires.
#2 - re: residency, you should try and apply to programs that sponsor either j1 or h1, preferably the latter, however ur husband's waiver situation may affect your ability to get h1, as his 2yr HRR will affect you too.

please advise!

yeah my j2 expires with my husband`s j1..but then what? can i continue my residency on another visa or do i have to leave it incomplete and go back if he has to?

if the program is willing to sponsor h1, is it lawfully appropriate? what would be the procedure for it? can it be done from here or do i have to go back to my homme country?

please advise.

I'm not sure you can get an H1 without evidence of your husband fulfilling the 2 yr HRR or obtaining a waiver, your best bey may be getting J1 on your own merit, but that subjects you to a 2yr HRR.
